Medida cautelar do Tribunal de Contas havia suspendido o pregão questionado por participante

Após o Tribunal de Contas do Estado do Paraná (TCE-PR) ordenar, por meio de medida cautelar, a suspensão do Pregão Eletrônico nº 92/2021, lançado pela Prefeitura de Jacarezinho, a administração desse município do Norte Pioneiro decidiu revogar o procedimento licitatório.
O certame tinha como objetivo a contratação de serviços terceirizados de recepcionista. A decisão da Corte, tomada em outubro do ano passado, atendeu a pedido feito em Representação da Lei nº 8.666/93 (Lei de Licitações e Contratos) formulada por empresa interessada na disputa.
Conforme a representante, o edital do certame exigia, de forma indevida, que, como requisito para participar da disputa, as licitantes, assim como seus respectivos responsáveis técnicos, possuíssem registro junto ao Conselho Regional de Administração (CRA).
Segundo ela, tanto a jurisprudência do Tribunal de Contas da União (TCU) quanto a do próprio TCE-PR fixaram o entendimento de que é irregular a imposição de tal exigência a empresas especializadas em terceirização de mão de obra.
Na ocasião, o relator do processo, conselheiro Ivens Linhares, deu razão à peticionária. De acordo com ele, o artigo 30, inciso I, da Lei de Licitações dispõe que somente pode ser exigido registro em conselho responsável por fiscalizar a atividade básica ou serviço preponderante da licitação. Dessa forma, Linhares concluiu que a exigência de inscrição junto ao CRA somente seria válida se a atividade profissional de técnico de administração correspondesse ao serviço almejado pela licitação – o que não era o caso.
Decisão
Contudo, diante da decisão tomada pelo município de revogar o procedimento licitatório, o relator manifestou-se pelo encerramento do processo em função da perda de objeto, seguindo o posicionamento defendido na instrução da Coordenadoria de Gestão Municipal (CGM) da Corte e no parecer do Ministério Público de Contas (MPC-PR) sobre o caso.
Os demais membros do Tribunal Pleno do TCE-PR acompanharam, por unanimidade, o voto do relator na sessão de plenário virtual nº 1/2022, concluída em 3 de fevereiro. A decisão está contida no Acórdão nº 180/22 – Tribunal Pleno, veiculado no dia 9 do mesmo mês, na edição nº 2.707 do Diário Eletrônico do TCE-PR (DETC).
